§ 1. General Provisions
- These Terms of Service govern the use of the Evolve & Thrive online educational platform, operated by Evolve & Thrive Learning Inc. By creating an account or using our services, you agree to be bound by these terms.
- The platform is intended for individuals who are at least 18 years of age. By using the services, you represent and warrant that you meet this age requirement.
- We reserve the right to modify these terms at any time. We will notify you of any significant changes, and your continued use of the platform after such changes constitutes your acceptance of the new terms.
- These terms constitute the entire agreement between you and Evolve & Thrive Learning Inc. regarding the use of the platform, superseding any prior agreements.
§ 2. Definitions
- Platform – The online educational platform available at our domain, operated by Evolve & Thrive Learning Inc.
- User – Any natural person who creates an account and uses the services provided by the Platform, in accordance with these Regulations.
- Account – A personalized profile created by a User upon registration, allowing access to the Platform's Services.
- Services – All educational materials, courses, tools, and functionalities made available to the User through the Platform.
- Regulations – This document, the Terms of Service, which outlines the rules for using the Platform.
§ 3. Type and Scope of Services Provided
- The Platform provides access to a library of online courses covering topics such as technology, productivity, and communication. The scope of access depends on the User's selected subscription plan (e.g., Explorer, Pro, Business).
- Services include video lectures, downloadable resources, quizzes, and community forums. Some plans may include additional benefits like course completion certificates.
- The content provided is for educational and informational purposes only and does not constitute professional advice. Evolve & Thrive is not liable for any actions taken based on course content.
- We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice to the User.
§ 4. Technical Requirements
- To use the Platform, the User must have a device with access to the Internet and a modern web browser (e.g., Chrome, Firefox, Safari, Edge) with JavaScript and cookies enabled.
- The User is responsible for ensuring their device meets these technical requirements and for any costs associated with internet access.
- We are not responsible for any malfunctions or interruptions in service resulting from the User's failure to meet these technical requirements.
§ 5. Rights and Obligations of the User
- The User agrees to provide accurate and complete information during registration and to keep their account information updated. The User is responsible for maintaining the confidentiality of their password.
- The User agrees to use the Platform only for lawful purposes and in accordance with these Regulations. You may not share your account access with others or resell any content.
- All content on the Platform, including courses, text, and graphics, is the intellectual property of Evolve & Thrive Learning Inc. and is protected by copyright law. The User is granted a limited, non-exclusive license to access content for personal, non-commercial use.
- The User is prohibited from posting any content that is unlawful, offensive, or infringing on the rights of others in the community forums or any other part of the platform.
- Violation of these terms may result in the suspension or termination of the User's account without a refund, at our sole discretion.
§ 6. Final Provisions
- These Regulations shall be governed by and construed in accordance with the laws of the province of Manitoba and the federal laws of Canada applicable therein.
- Any disputes arising from these terms will be resolved in the competent courts of Winnipeg, Manitoba.
- If any provision of these Regulations is found to be unenforceable, the remaining provisions will continue to be in full force and effect.
